Over the last several months, the 340B program has witnessed an increased focus on integrity and compliance. In September, the Government Accountability Office (GAO) released a Congressionally mandated report that called on the Health Resources and Services Administration (HRSA) to conduct audits of covered entities to ensure that 340B-discounted drugs are not provided to ineligible patients. HRSA has begun conducting audits, and pharmaceutical manufacturers are also stepping up their efforts to scrutinize whether covered entities are complying with the law.
The GAO also recommended that HRSA finalize new, more specific guidance on the definition of a 340B patient and take steps to ensure pharmaceutical manufacturers are not discriminating against covered entities when restricting distribution of their drugs. Coinciding with the report’s release, three senior members of Congress requested that HRSA inform them of what actions the agency has taken to oversee the administration and effectiveness of the program. There are also questions being raised about whether the 340B program is a factor in drug shortages. With elections around the corner, both supporters and detractors of the 340B program on Capitol Hill are stepping up efforts to make changes to the program.
